Kashmir LIVE updates: The government on Monday revoked the special status of Jammu and Kashmir, saying the far-reaching political move would fix a historical blunder in the restive state.

Home Minister Amit Shah told the Rajya Sabha the government would scrap Article 370, a constitutional provision that grants a measure of autonomy to Jammu and Kashmir including the right to make its own laws.

Singh moved a bill proposing the bifurcation of Jammu and Kashmir into two union territories -- Jammu and Kashmir division and Ladakh. Jammu and Kashmir will have a legislature like Delhi and Puducherry. Ladakh won’t have a representative assembly, like in Chandigarh.

Article 371A states that no act of Parliament -- with respect to religious or social practices of the Nagas, their customary law and procedure, administration of civil and criminal justice involving decisions according to Naga customary law, ownership and transfer of land and its resources -- shall apply to the state unless the Assembly decides by a resolution.

Demanding that the government "end the seige in Kashmir", CPI-ML Liberation party tweeted that the government through its decision had ended the last bridge between the state and the constitution.
 
"By effectively scrapping #Article370 and 35A, the Modi govt has burnt the constitutional & historical bridge that connected J&K with the rest of India. The govt's obsession with setting the clock back is pushing the country back into the turbulence of the 1940s," tweeted CPI-ML Liberation from its official handle.
 
"Governance by conspiracy and coup: that's democracy under the Modi-Shah duo ploy! Like the 500 and 1000 rupee notes, Article 370 and the entire spirit of the Constitution has been junked today," it alleged.
 
Raja said that the government's move in Jammu and Kashmir was an attempt to try and distract people from the state of the economy which is in a bad way.
 
"Instead of discussing the economic policies, they are diverting the attention of the people and creating panic in the country in the name of nationalism. The present government is RSS controlled and they are following the agenda of dismantling J&K piece by piece," said Raja.

What is Article 370?

Article 370 of the Indian Constitution grants an autonomous status to Jammu and Kashmir.

In October 1947, the then Maharaja of Kashmir, Hari Singh, signed an Instrument of Accession that specified three subjects on which Jammu & Kashmir would transfer its power to the government of India:

3. Communications
 
In March 1948, the Maharaja appointed an interim government in the state, with Sheikh Abdullah as prime minister. In July 1949, Sheikh Abdullah and three other colleagues joined the Indian Constituent Assembly and negotiated the special status of J&K, leading to the adoption of Article 370. The controversial provision was drafted by Sheikh Abdullah.

United Nations appeals for maximum restraint along LoC

Senior Congress leader P Chidambaram criticised the Narendra Modi-led government for the house arrest of senior political leaders in Jammu and Kashmir, saying that it was a signal that the government will defy all democratic norms to achieve its objects.
 
Senior Congress leader and former Union Ministers Shashi Tharoor and Jyotiraditya Scindia condemned the government over its decision to put the political leaders under house arrest.
 
Tharoor tweeted: "You are not alone Omar Abdullah. Every Indian democrat will stand with the decent mainstream leaders in Kashmir as you face up to whatever the government has in store for our country. Parliament is still in session and our voices will not be stilled.
 
"What is going on in J&K? Why would leaders be arrested overnight while having done no wrong? If Kashmiris are our citizens and their leaders our partners, surely the mainstream ones must be kept on board while we act against terrorists and separatists? If we alienate them, who's left?"
 
Scindia also took to twitter and wrote: "The uncertainty and fear only serves to worsen the situation. Government must be open, transparent, and take people and opposition leaders into confidence.
 
"Leaders being placed under house arrest overnight while mass hysteria and deployment of troops, both continue to rise. The situation in Kashmir is indeed worrying. The govt must make its intentions clear."
Speculation has been rife that the Centre has plans to do away with Article 35A, which gives exclusive rights to the state's residentsin government jobs and land.

In October 1947, the then Maharaja of Kashmir, Hari Singh, signed an Instrument of Accession that specified three subjects on which Jammu & Kashmir would transfer its power to the government of India:

In March 1948, the Maharaja appointed an interim government in the state, with Sheikh Abdullah as prime minister. In July 1949, Sheikh Abdullah and three other colleagues joined the Indian Constituent Assembly and negotiated the special status of J&K, leading to the adoption of Article 370. Kashmir issue: What are the provisions of Article 370?

Parliament needs the Jammu & Kashmir government's approval for applying laws in the state — except in cases of defence, foreign affairs, finance, and communications.
 
The law of citizenship, ownership of property, and fundamental rights of the residents of Jammu & Kashmir is different from the residents living in rest of India. Under Article 370, citizens from other states cannot buy property in Jammu & Kashmir. Under Article 370, the Centre has no power to declare a financial emergency in the state.
 
It is important to note that Article 370(1)(c) explicitly mentions that Article 1 of the Indian Constitution applies to Kashmir through Article 370. Article 1 lists the states of the Union. This means that it is Article 370 that binds the state of J&K to the Indian Union. Removing Article 370, which can be done by a Presidential Order, would render the state independent of India, unless new overriding laws are made.

Section 144 of the Criminal Procedure Code (CrPC) of 1973 authorizes the Executive Magistrate of any state or territory to issue an order to prohibit the assembly of five or more people in an area. According to the law, every member of such ‘unlawful assembly’ can be booked for engaging in rioting. Section 144 is imposed in in urgent cases of nuisance or apprehended danger of some event that has the potential to cause trouble or damage to human life or property. Section 144 of CrPC generally prohibits public gathering.
